What this covers, right now

These terms govern your use of the Phound waitlist at phoundit.app, operated by The Louest Company LLC. The Phound mobile app is not yet published. When it launches, it will come with its own supplemental terms covering the app itself and any in-app purchases, and you'll be asked to accept those separately.

The waitlist and referral program

Joining the waitlist reserves you a spot and an Artifact number. Your queue position moves based on referrals, but it's an estimate, not a promise of when, or whether, you'll get access to the app on any particular date. We may change how queue position is calculated, or end the referral program, at any time.

Referral credit only counts once the person you referred confirms their own signup. Creating fake accounts, using someone else's email without permission, or otherwise gaming the referral system may result in your entry being removed.

No guarantee of launch

Phound is a product in active development. We intend to launch it, but joining this waitlist is not a purchase, a contract for future service, or a guarantee that the app will launch by any specific date, or at all.

What belongs to us

The Phound name, the registrar card design, the barcode mark, and the site's content and design belong to The Louest Company LLC. You're welcome to share your own referral link and registrar card as intended by the product, but you may not otherwise copy or reuse our branding or content without permission.

What you're responsible for

You're responsible for the accuracy of the information you give us (your email, in particular, needs to be real, since referral credit and your confirmation both depend on it) and for keeping your referral link from being used to game the system on your behalf.

No warranty

The waitlist site is provided as-is. We don't guarantee it will be uninterrupted or error-free, and we're not liable for any indirect or consequential damages arising from your use of it.

Limitation of liability

To the fullest extent permitted by law, The Louest Company LLC's total liability to you for anything arising from the waitlist is limited to the amount you've paid us, which, for the waitlist itself, is zero.

Governing law

These terms are governed by the laws of the State of California, without regard to conflict-of-law principles.

Changes to these terms

We may update these terms as the product evolves. If we make a material change, we'll post the update here and, where practical, notify active waitlist members by email. Continuing to use the waitlist after a change means you accept the updated terms.
